DraftKar.com is operated by VIAVI HOSPITALITY LLP (LLP ID: AAV-6528), a limited liability partnership incorporated on 1st February 2021 under the laws of India. These terms constitute the entire agreement between you and VIAVI HOSPITALITY LLP regarding your use of our platform and services.
2. Description of Service
DraftKar.com provides an AI-powered document generation service that creates legal document templates based on information provided by users. Our platform generates documents including but not limited to rental agreements, leave and license agreements, non-disclosure agreements, service agreements, affidavits, and wills. All documents are generated specifically for use within India and comply with Indian legal standards. The service is provided on an as-is basis and is designed to provide draft documents that users can download and modify as needed.
3. User Accounts
To use certain features of DraftKar.com, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account. You must provide accurate, current, and complete information during registration and keep all account information updated. We reserve the right to suspend or terminate your account if any information provided is false, inaccurate, or incomplete.
4. Payments and Refunds
DraftKar.com offers both per-document and monthly subscription pricing. All prices are listed in Indian Rupees (INR). Payments are processed securely through Razorpay, our authorized payment processor. By providing payment information, you authorize VIAVI HOSPITALITY LLP to charge your payment method for the service. All sales are final except as provided in our Refund Policy. Refunds are available only in cases of technical service failure or duplicate transactions. We do not offer refunds for change of mind or after a document has been downloaded. 5. AI Disclaimer
The documents generated by DraftKar.com are AI-powered draft documents and should be treated as templates and starting points for your legal documents. While our AI technology is designed to generate legally compliant documents for use in India, these documents are not a substitute for professional legal advice. We strongly recommend that users review all generated documents carefully and consult with qualified legal professionals before signing or using any document in legal proceedings or formal transactions. VIAVI HOSPITALITY LLP does not guarantee that any generated document will be accepted by all courts, government agencies, or third parties. The accuracy and enforceability of each document depend on the information provided by the user and the specific circumstances of use.
6. Intellectual Property
All content on DraftKar.com, including but not limited to software, text, graphics, logos, images, and document templates, is the property of VIAVI HOSPITALITY LLP or its content suppliers and is protected by international copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable license to access and use DraftKar.com for personal, non-commercial purposes only. You may not reproduce, modify, distribute, transmit, display, publish, or create derivative works from any content on our platform without prior written permission from VIAVI HOSPITALITY LLP. Generated documents are provided for your personal use and may not be redistributed, sold, or used for commercial purposes without our express written consent.
7. Limitation of Liability
To the fullest extent permitted by law, VIAVI HOSPITALITY LLP and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data, arising from or related to your use of or inability to use the platform or services, even if VIAVI HOSPITALITY LLP has been advised of the possibility of such damages. Our total liability to you for all claims arising from or relating to these terms or your use of the platform shall not exceed the amount you paid for the service in the past 30 days. Some jurisdictions do not allow the limitation of liability, so this limitation may not apply to you.
8. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of India, specifically the laws of the State of Karnataka. Both you and VIAVI HOSPITALITY LLP agree that any legal proceedings arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India. You expressly consent to the jurisdiction and venue of these courts and waive any objection based on inconvenient forum.
9. Termination
VIAVI HOSPITALITY LLP reserves the right to terminate or suspend your account and access to the platform at any time, with or without cause, with or without notice. This right is absolute and may be exercised at our sole discretion. You may terminate your account at any time by contacting us at support@draftkar.com. Upon termination, your right to use the platform ceases immediately. Sections that by their nature should survive termination, including Limitation of Liability, Intellectual Property, and Governing Law, shall survive any termination of these terms.
10. Modifications to Terms
VIAVI HOSPITALITY LLP reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the platform. Your continued use of DraftKar.com following the posting of revised terms means that you accept and agree to the changes. We recommend reviewing these terms regularly to stay informed of any changes. If you do not agree to the modified terms, you must stop using the platform immediately.
